RMKS/1. REF A ANNOUNCED THAT SECNAV HAS APPROVED THE RESULTS OF THE FY-12
SELECTIVE EARLY RETIREMENT (SER) BOARDS AND REF B ANNOUNCED THAT ALL MEMBERS
SELECTED FOR EARLY RETIREMENT HAVE BEEN INDIVIDUALLY NOTIFIED.
2. REF C DIRECTS THAT OFFICERS SELECTED FOR EARLY RETIREMENT, IF RETIREMENT
ELIGIBLE, MUST RETIRE NO LATER THAN THE FIRST DAY OF THE SEVENTH MONTH
FOLLOWING SECNAV APPROVAL OF THE RESULTS OF THE BOARDS.
BASED ON THE DATE OF SECNAV'S APPROVAL OF THE SER BOARD RESULTS, THE MANDATORY
RETIREMENT DATE IS 01APR12.
3. REF C AUTHORIZES SECNAV TO DEFER FOR NOT MORE THAN 90 DAYS THE RETIREMENT
OF AN OFFICER APPROVED FOR EARLY RETIREMENT BY A SER BOARD IN ORDER TO PREVENT
A PERSONAL HARDSHIP TO THE OFFICER OR FOR OTHER HUMANITARIAN REASONS. THIS
NAVADMIN PROVIDES POLICY AND PROCEDURAL GUIDANCE ON THE ROUTING AND
CONSIDERATION OF SUCH REQUESTS.
4. PER REF C, DEFERRAL OF RETIREMENT SHALL BE MADE ON A CASE-BY-CASE BASIS
CONSIDERING THE CIRCUMSTANCES OF THE PARTICULAR OFFICER CONCERNED; AUTHORITY
TO GRANT DEFERRAL LIES SOLELY WITH SECNAV AND MAY NOT BE DELEGATED.
5. DETERMINING WHETHER A PERSONAL HARDSHIP, OR OTHER HUMANITARIAN REASON
WARRANTS DEFERRAL, IS A MATTER UNDER THE DISCRETION OF SECNAV. THE UNDERLYING
GUIDANCE IS INTENDED TO ASSIST MEMBERS AND COMMANDS IN EVALUATING REQUESTS AND
INDIVIDUAL CIRCUMSTANCES; IT DOES NOT LIMIT SECNAV'S DISCRETION. A PERSONAL
HARDSHIP OR OTHER HUMANITARIAN REASON WARRANTING DEFERRAL OF RETIREMENT SHOULD
BE ONE THAT DEMONSTRATES THE FOLLOWING CRITERIA:
A. THE HARDSHIP AFFECTS THE OFFICER PERSONALLY OR AFFECTS A MEMBER OF THE
OFFICERS IMMEDIATE FAMILY.
B. THE HARDSHIP IS SEVERE AND NOT ONE NORMALLY ENCOUNTERED AND RESOLVED
BY OTHER MEMBERS OF THE NAVAL SERVICE WHO RETIRE.
C. THE HARDSHIP WILL BE ELIMINATED OR MATERIALLY ALLEVIATED BY DEFERRAL
OF RETIREMENT FOR 90 DAYS.
D. NO OTHER REASONABLE MEANS EXIST TO ALLEVIATE THE HARDSHIP.
E. THE HARDSHIP IS NOT BASED UPON PERSONAL CONVENIENCE, FINANCIAL OR
BUSINESS REASONS.
6. OFFICERS REQUESTING A 90 DAY DEFERRAL OF RETIREMENT SHOULD SUBMIT REQUESTS
TO COMMANDER, NAVY PERSONNEL COMMAND (PERS-835), VIA THEIR COMMANDING OFFICER
AND FIRST FLAG OFFICER IN THEIR CHAIN OF COMMAND.
